TERMINI E CONDIZIONI D’USO – PING

1. OGGETTO DEL SERVIZIO
Ping è un’applicazione mobile che consente a utenti maggiorenni di:
- creare eventi geolocalizzati, denominati “Ping”;
- visualizzare Ping creati da altri utenti;
- richiedere di partecipare a un Ping;
- accettare o rifiutare richieste di partecipazione, se organizzatori;
- comunicare tramite chat dirette e chat collegate ai Ping;
- gestire un profilo personale;
- bloccare o segnalare utenti, contenuti e comportamenti.

L’utilizzo dell’app comporta l’accettazione dei presenti Termini, dell’Informativa Privacy e delle Linee Guida della Community disponibili nell’app e sul sito www.getping.it.
2. REQUISITI DI ETÀ
Ping è riservata esclusivamente a utenti di età pari o superiore a 18 anni.
Registrandosi, l’utente dichiara di essere maggiorenne e di fornire informazioni veritiere.
Il Gestore può limitare, sospendere o chiudere account qualora emergano elementi contrari ai presenti requisiti.
3. ACCOUNT UTENTE
Per utilizzare Ping è necessario creare un account.
L’utente si impegna a:
- fornire informazioni corrette e aggiornate;
- non creare account falsi o intestati a terzi;
- non impersonare altre persone;
- mantenere riservate le proprie credenziali;
- utilizzare l’account nel rispetto della legge, dei presenti Termini e delle Linee Guida della Community.
L’utente resta responsabile dell’attività svolta tramite il proprio account, salvo i casi di accesso abusivo non imputabili allo stesso.
4. FUNZIONAMENTO DEI PING
Gli utenti possono creare Ping indicando informazioni quali:
- titolo;
- descrizione;
- categoria;
- luogo;
- data e orario;
- durata;
- numero massimo di partecipanti;
- eventuale costo di partecipazione dichiarato.
Gli altri utenti possono richiedere di partecipare. L’organizzatore può accettare o rifiutare la richiesta, nonché rimuovere partecipanti secondo le funzionalità disponibili.
Ping facilita l’incontro tra utenti, ma non organizza direttamente gli eventi e non è parte dei rapporti personali o economici che possono nascere tra gli utenti.
5. EVENTUALI COSTI INDICATI NEI PING
Un Ping può riportare un costo di partecipazione dichiarato dall’organizzatore.
Ping:
- non incassa tali importi;
- non elabora pagamenti;
- non custodisce fondi;
- non garantisce rimborsi;
- non interviene negli accordi economici tra utenti.
Qualsiasi pagamento eventualmente concordato resta gestito direttamente tra gli utenti interessati, sotto la loro esclusiva responsabilità, salvo eventuali funzionalità future espressamente introdotte dal Servizio.
6. PROFILO E CONTENUTI DELL’UTENTE
Gli utenti possono pubblicare o caricare contenuti quali:
- foto profilo;
- immagini della galleria;
- descrizione personale;
- informazioni relative ai Ping;
- messaggi testuali nelle chat.
L’utente è responsabile dei contenuti che pubblica e garantisce di avere i diritti e le autorizzazioni necessarie per utilizzarli.
È vietato caricare contenuti illeciti, ingannevoli, offensivi, discriminatori, lesivi della privacy o dei diritti di terzi.
7. LICENZA TECNICA SUI CONTENUTI
Caricando contenuti su Ping, l’utente concede al Gestore una licenza non esclusiva, gratuita e limitata alle sole finalità di:
- ospitare;
- memorizzare;
- mostrare;
- trasmettere;
- gestire tecnicamente;
- moderare;
- proteggere e migliorare il Servizio.
La licenza opera esclusivamente nell’ambito del funzionamento dell’app e non autorizza l’uso dei contenuti per campagne pubblicitarie esterne o sfruttamenti commerciali autonomi.
8. COMPORTAMENTI VIETATI
È vietato utilizzare Ping per:
- organizzare o promuovere eventi illegali o pericolosi;
- molestare, minacciare, perseguitare o intimidire altri utenti;
- pubblicare contenuti d’odio, discriminatori, diffamatori o violenti;
- diffondere spam, truffe, phishing o comunicazioni ingannevoli;
- pubblicare dati personali o sensibili di terzi senza autorizzazione;
- pubblicare indirizzi privati o informazioni che possano mettere a rischio persone;
- usare immagini, identità o contenuti altrui senza autorizzazione;
- aggirare blocchi, sospensioni o misure di sicurezza;
- interferire con il funzionamento tecnico dell’app.
Le regole di comportamento sono ulteriormente dettagliate nelle Linee Guida della Community.
9. CHAT E INTERAZIONI TRA UTENTI
Ping consente chat dirette e chat collegate ai Ping.
Gli utenti devono utilizzare tali strumenti in modo lecito e rispettoso.
Il contenuto delle chat resta soggetto alle regole del Servizio e può essere esaminato nei casi di segnalazione, sicurezza, abuso o obblighi di legge.
10. BLOCCO, SEGNALAZIONI E MODERAZIONE
Gli utenti possono bloccare altri utenti e segnalare profili, Ping, messaggi o comportamenti contrari alle regole dell’app.
Ping può, nei limiti consentiti dalla legge:
- esaminare segnalazioni;
- limitare la visibilità di contenuti;
- rimuovere contenuti;
- sospendere temporaneamente account;
- chiudere account;
- eliminare account e contenuti nei casi previsti.
Tali misure possono essere adottate in presenza di violazioni dei presenti Termini, delle Linee Guida della Community, della legge o dei diritti di terzi, nonché per esigenze di sicurezza del Servizio.
11. LOCALIZZAZIONE
Ping può utilizzare la posizione del dispositivo, previa autorizzazione dell’utente, per mostrare eventi vicini e supportare la creazione di Ping geolocalizzati.
L’utente può revocare i permessi di localizzazione dalle impostazioni del dispositivo.
La disattivazione della posizione può limitare alcune funzionalità dell’app.
12. PROPRIETÀ INTELLETTUALE DEL SERVIZIO
Il nome Ping, il software, l’interfaccia, il design, i contenuti grafici e gli elementi funzionali dell’app sono protetti dalla normativa applicabile e appartengono al Gestore o ai relativi aventi diritto.
L’utente ottiene esclusivamente un diritto personale, limitato e revocabile di utilizzare il Servizio nel rispetto dei presenti Termini.
13. DISPONIBILITÀ DEL SERVIZIO
Il Gestore si impegna a mantenere Ping funzionante e sicura, ma non garantisce che l’app sia sempre disponibile, priva di interruzioni o compatibile con ogni dispositivo o sistema operativo.
Il Servizio può essere aggiornato, modificato, sospeso o interrotto, in tutto o in parte, per esigenze tecniche, operative, legali o di sicurezza.
14. RESPONSABILITÀ
Ping opera come piattaforma tecnica di incontro e comunicazione tra utenti.
Nei limiti consentiti dalla legge, il Gestore non risponde per:
- condotte degli utenti;
- contenuti pubblicati dagli utenti;
- eventi creati dagli utenti;
- incontri offline;
- pagamenti o accordi economici conclusi direttamente tra utenti;
- informazioni false o incomplete fornite dagli utenti;
- utilizzo improprio dell’app.
Resta ferma la responsabilità del Gestore nei casi inderogabili previsti dalla normativa applicabile.
15. PRIVACY
Il trattamento dei dati personali è disciplinato dall’Informativa Privacy disponibile nell’app e sul sito www.getping.it.
L’utente è invitato a leggerla attentamente prima di utilizzare il Servizio.
16. SOSPENSIONE E CANCELLAZIONE DELL’ACCOUNT
Il Gestore può sospendere o chiudere account in caso di violazione dei presenti Termini, delle Linee Guida della Community, della legge o dei diritti di terzi.
L’utente può richiedere la cancellazione del proprio account tramite le funzionalità disponibili nell’app.
La cancellazione sarà gestita secondo le procedure tecniche e amministrative del Servizio e potrà comportare la rimozione di account, Ping, messaggi e altri dati collegati, salvo quanto previsto dall’Informativa Privacy o dalla legge.
17. MODIFICHE AI TERMINI
Il Gestore può aggiornare i presenti Termini quando necessario, ad esempio per modifiche del Servizio, aggiornamenti normativi o esigenze di sicurezza.
La versione aggiornata sarà resa disponibile nell’app e sul sito www.getping.it.
Quando richiesto dalla legge o dalla natura della modifica, potrà essere richiesta una nuova accettazione.
18. LEGGE APPLICABILE
I presenti Termini sono regolati dalla legge italiana.
Se l’utente agisce come consumatore, restano ferme le tutele inderogabili previste dalla normativa applicabile.

1. PURPOSE OF THE SERVICE
Ping is a mobile application that allows adult users to:
- create geolocated events, called “Pings”;
- view Pings created by other users;
- request to participate in a Ping;
- accept or reject participation requests, when acting as organisers;
- communicate through direct chats and chats linked to Pings;
- manage a personal profile;
- block or report users, content, and behaviour.

Use of the app entails acceptance of these Terms, the Privacy Notice, and the Community Guidelines available in the app and on the website www.getping.it.
2. AGE REQUIREMENTS
Ping is reserved exclusively for users aged 18 or over.
By registering, the user declares that they are an adult and that they provide truthful information.
The Manager may limit, suspend, or close accounts where elements emerge that are contrary to these requirements.
3. USER ACCOUNT
To use Ping, an account must be created.
The user undertakes to:
- provide correct and up-to-date information;
- not create fake accounts or accounts registered to third parties;
- not impersonate other people;
- keep their credentials confidential;
- use the account in compliance with the law, these Terms, and the Community Guidelines.
The user remains responsible for activity carried out through their account, except in cases of unauthorised access not attributable to the user.
4. HOW PINGS WORK
Users may create Pings by indicating information such as:
- title;
- description;
- category;
- place;
- date and time;
- duration;
- maximum number of participants;
- any participation cost declared.
Other users may request to participate. The organiser may accept or reject the request, and may remove participants according to the available features.
Ping facilitates meetings between users, but does not directly organise events and is not a party to any personal or economic relationships that may arise between users.
5. ANY COSTS INDICATED IN PINGS
A Ping may indicate a participation cost declared by the organiser.
Ping:
- does not collect such amounts;
- does not process payments;
- does not hold funds;
- does not guarantee refunds;
- does not intervene in economic agreements between users.
Any payment that may be agreed remains managed directly between the users concerned, under their sole responsibility, without prejudice to any future features expressly introduced by the Service.
6. USER PROFILE AND CONTENT
Users may publish or upload content such as:
- profile photos;
- gallery images;
- personal descriptions;
- information relating to Pings;
- text messages in chats.
The user is responsible for the content they publish and guarantees that they have the rights and authorisations necessary to use it.
It is prohibited to upload unlawful, misleading, offensive, discriminatory content, or content that infringes privacy or third-party rights.
7. TECHNICAL LICENCE FOR CONTENT
By uploading content to Ping, the user grants the Manager a non-exclusive, free-of-charge licence limited solely to the purposes of:
- hosting;
- storing;
- displaying;
- transmitting;
- technically managing;
- moderating;
- protecting and improving the Service.
The licence applies exclusively within the operation of the app and does not authorise the use of content for external advertising campaigns or independent commercial exploitation.
8. PROHIBITED CONDUCT
Ping must not be used to:
- organise or promote illegal or dangerous events;
- harass, threaten, stalk, or intimidate other users;
- publish hateful, discriminatory, defamatory, or violent content;
- spread spam, scams, phishing, or misleading communications;
- publish personal or sensitive data of third parties without authorisation;
- publish private addresses or information that may put people at risk;
- use images, identities, or content belonging to others without authorisation;
- circumvent blocks, suspensions, or security measures;
- interfere with the technical operation of the app.
The rules of conduct are further detailed in the Community Guidelines.
9. CHATS AND INTERACTIONS BETWEEN USERS
Ping allows direct chats and chats linked to Pings.
Users must use these tools lawfully and respectfully.
Chat content remains subject to the rules of the Service and may be reviewed in cases involving reports, security, abuse, or legal obligations.
10. BLOCKING, REPORTS, AND MODERATION
Users may block other users and report profiles, Pings, messages, or behaviour contrary to the rules of the app.
Ping may, within the limits permitted by law:
- review reports;
- limit visibility of content;
- remove content;
- temporarily suspend accounts;
- close accounts;
- delete accounts and content in the cases provided for.
Such measures may be adopted in the presence of violations of these Terms, the Community Guidelines, the law, or third-party rights, as well as for Service security needs.
11. LOCATION
Ping may use the device location, subject to the user’s permission, to show nearby events and support the creation of geolocated Pings.
The user may revoke location permissions from the device settings.
Disabling location may limit certain app features.
12. INTELLECTUAL PROPERTY OF THE SERVICE
The Ping name, software, interface, design, graphic content, and functional elements of the app are protected by applicable law and belong to the Manager or the relevant rights holders.
The user obtains only a personal, limited, and revocable right to use the Service in compliance with these Terms.
13. SERVICE AVAILABILITY
The Manager undertakes to keep Ping operational and secure, but does not guarantee that the app will always be available, uninterrupted, or compatible with every device or operating system.
The Service may be updated, modified, suspended, or discontinued, in whole or in part, for technical, operational, legal, or security reasons.
14. LIABILITY
Ping operates as a technical platform for meeting and communication between users.
To the extent permitted by law, the Manager is not liable for:
- users’ conduct;
- content published by users;
- events created by users;
- offline meetings;
- payments or economic agreements concluded directly between users;
- false or incomplete information provided by users;
- improper use of the app.
The Manager’s liability remains unaffected in mandatory cases provided for by applicable law.
15. PRIVACY
The processing of personal data is governed by the Privacy Notice available in the app and on the website www.getping.it.
The user is invited to read it carefully before using the Service.
16. SUSPENSION AND DELETION OF THE ACCOUNT
The Manager may suspend or close accounts in the event of a breach of these Terms, the Community Guidelines, the law, or third-party rights.
The user may request deletion of their account through the features available in the app.
Deletion will be managed according to the technical and administrative procedures of the Service and may result in the removal of accounts, Pings, messages, and other linked data, without prejudice to what is provided by the Privacy Notice or by law.
17. CHANGES TO THE TERMS
The Manager may update these Terms when necessary, for example due to changes to the Service, regulatory updates, or security needs.
The updated version will be made available in the app and on the website www.getping.it.
Where required by law or by the nature of the change, new acceptance may be requested.
18. GOVERNING LAW
These Terms are governed by Italian law.
If the user acts as a consumer, the mandatory protections provided by applicable law remain unaffected.
